By utilizing our hardware repair, software development, or digital marketing services, you agree to the following terms and conditions. Please read them carefully.

1 Scope of Services

Cobalt Systems provides hardware diagnostics and repair for smartphones, computers, and tablets, as well as digital services including custom website development, software engineering, and digital marketing.

2 Limitation of Liability and Assumption of Risk

Please read carefully. Submission of your device for diagnostics or repair constitutes explicit and binding acceptance of this waiver of liability.

While Cobalt Systems ("Company") exercises all commercially reasonable care in the handling, diagnosis, and repair of client property, the repair of electronic devices involves inherent risks, including but not limited to the exacerbation of existing micro-fractures, logic board degradation, or catastrophic hardware failure. By surrendering your device to the Company or its authorized representatives, you ("Client") acknowledge, understand, and agree to the following:

  • Release and waiver of liability: To the maximum extent permitted by applicable law, the Client agrees to release, indemnify, and hold harmless Cobalt Systems, its owners, employees, contractors, and affiliates from any and all claims, liabilities, demands, or damages arising out of or related to the diagnostic or repair process. In the rare event that Cobalt Systems is found liable for any damages, total liability is strictly capped at the amount the customer has paid for the specific service in question, up to a maximum limit of $100. This limitation applies to all services and explicitly excludes any indirect, incidental, or consequential damages.
  • Waiver of data preservation claims: The Company assumes no responsibility whatsoever for the preservation, recovery, or protection of any data, software, personal files, or intellectual property stored on the device. The Client is solely responsible for performing a comprehensive data backup prior to submitting the device. The Company is strictly excluded from any liability regarding data loss, corruption, or compromise.
  • Implied consent by surrender: The physical handover, mailing, or delivery of the device to any Cobalt Systems personnel or facility constitutes the Client's legally binding consent to these terms. The Client explicitly assumes all risk associated with the diagnostic and repair procedures performed by the Company.

3 Unclaimed Property

If you do not pick up your device within a set timeframe, typically 30 to 60 days after notification that the repair is complete or deemed unrepairable, the Company reserves the explicit right to sell, recycle, or otherwise dispose of your device in order to recover incurred labor, parts, and storage costs. Upon expiration of this timeframe, the device is legally considered abandoned property and ownership transfers solely to the Company.

4 Warranty on Repairs

We stand by our workmanship. All hardware repairs are backed by a 90-day limited warranty covering the specific parts replaced and the direct labor associated with that specific repair. This warranty is instantly voided if the device suffers subsequent physical damage, such as being dropped and cracked again, liquid damage, or if the device is opened by the customer or an unauthorized third party.

5 Use of Refurbished Parts

The Company explicitly reserves the right to use refurbished, generic, or non-original equipment manufacturer parts to complete the repair. All parts, whether original or third-party, are fully tested and covered under our standard limited warranty unless explicitly stated otherwise in writing prior to the repair.

6 Force Majeure and Acts of God

The Company shall not be held liable if your device is damaged, lost, or destroyed while in our possession due to events outside of our reasonable control. Such events include, but are not limited to, floods, fires, earthquakes, severe weather, power surges, theft, vandalism, or damage occurring during shipping and transit by third-party couriers.

7 Digital Solutions and Web Development

For custom software and web development services, the specific project scope, timelines, and payment milestones will be outlined in a separate statement of work. A non-refundable deposit is strictly required before any development begins. Cobalt Systems retains all rights to any underlying code libraries and assets used until full and final payment is received.

8 Right to Refuse Service

Cobalt Systems reserves the right to refuse service to anyone, at any time, for any reason, including but not limited to devices that are hazardous, severely bio-hazardous, locked due to theft, or suspected of containing illegal material.

9 Governing Law

These terms of service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of Missouri.
